Product Conformity Warranty

The conformity warranty for products sold by the Seller to the Consumer Customer is provided under the provisions of Legislative Decree No. 206 of September 6, 2005 (Consumer Code) on warranties in the sale of consumer goods. The Seller provides the official warranty for two years from the date of purchase. The Consumer Customer forfeits the right to enforce the warranty if they do not report the non-conformity defect within two months of discovering it.

Conformity Warranty for Digital Products

The conformity warranty for digital products covers the following defects:

  • The digital product does not match the agreement.
  • The digital product lacks the essential features for its operation.
  • The digital product does not meet the usual standards of use and quality.

However, the warranty does not apply to digital products in cases of:

  • Misuse, unauthorized manipulation, or improper installation.
  • Malfunctions due to external factors, such as system compatibility issues, incorrect configurations, or viruses introduced by the Customer or third parties.
  • Modifications or alterations to the software made by the Customer or unauthorized parties.

Conformity Warranty for Physical Products

The conformity warranty for physical products covers the following defects:

  • The physical product does not match the agreement.
  • The physical product lacks essential features.
  • The physical product does not meet the usual standards of use and quality.

The warranty does not apply to physical products in the following cases:

  • Damage resulting from misuse, normal wear and tear, or unprofessional handling or installation.
  • Malfunctions due to short circuits or external factors such as voltage fluctuations, use of unauthorized accessories, falls, exposure to water or fire, or improper or abusive use.
  • Defects already known to the Customer at the time of purchase.

How to Exercise the Warranty

The Customer must agree with the Seller, even via email, on how to return and deliver the non-conforming product before sending it back. The Seller will inform the Customer of the location and shipping instructions for the product.

Once the product is received, the Seller will inspect it, potentially using the manufacturer’s facilities. If a conformity defect is found, the Seller will send the repaired product or provide a replacement.

If the product does not exhibit any conformity defects upon inspection, the Seller will inform the Customer of the repair or replacement costs. The Customer will be responsible for the shipping costs of products that do not show conformity defects.

In case of a conformity defect, the Seller may contact the Customer to offer a replacement with alternative products of equivalent or superior value and quality.
